Privacy Notice (KVKK).

This is an English translation provided for convenience. The legally binding version is the Turkish original; in case of any discrepancy, the Turkish text prevails.

This privacy notice has been prepared in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”) to explain how the personal data of people who visit the arya.codes website and contact us is processed.

1. Data controller

Your personal data is processed by Arya Codes Yazılım ve Tasarım Limited Şirketi (“Arya Codes”) as the data controller.

2. Personal data we process

• Contact details and the content of your request: the name, email address, topic and message you send us through the contact form or by email.
• Transaction security data: server logs technically kept by the hosting service when you visit the website (such as IP address, date and time, browser and device information).

3. Purposes of processing

• To receive, evaluate and respond to your contact requests, questions and partnership proposals,
• To ensure the security of the website and operate it technically,
• To fulfil our legal obligations and respond to requests from competent authorities.

4. Method of collection and legal grounds

Your personal data is collected electronically: by you through the contact form and email, and automatically during your visit in the case of server logs. This data is processed on the following legal grounds set out in Article 5(2) of the KVKK:

• (c) it is directly related to the conclusion or performance of a contract (with regard to partnership requests),
• (ç) it is necessary for the data controller to fulfil its legal obligations,
• (f) it is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (responding to requests and website security).

5. Transfer of personal data

Your personal data may be transferred to the following parties, limited to the purposes above:

• Service providers: Büyükweb (Türkiye) for delivering the contact form; Büyükweb (Türkiye) for hosting the website; Büyükweb (Türkiye) for email services (contact form messages and emails you send us).
• Competent public authorities: upon request by legally authorised authorities and to the extent required by law.

Your personal data is not transferred abroad; the service providers listed above are located in Turkey.

6. Retention period

Data processed in connection with contact requests is kept for 24 months after the request has been concluded; at the end of this period it is deleted, destroyed or anonymised. If the law requires a longer period, that period applies.

7. Your rights under the KVKK

Under Article 11 of the KVKK, you have the right to apply to the data controller to:

• Learn whether your personal data is processed,
• Request information about it if it has been processed,
• Learn the purpose of processing and whether it is used in line with that purpose,
• Know the third parties in Turkey or abroad to whom it has been transferred,
• Request correction if it has been processed incompletely or incorrectly,
• Request its deletion or destruction under the conditions of Article 7 of the KVKK,
• Request that corrections, deletions and destructions be notified to the third parties to whom the data was transferred,
• Object to a result against you arising from the analysis of the processed data exclusively by automated systems,
• Claim compensation for damages if you suffer harm due to unlawful processing.

8. How to apply

You can send your requests, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing to Kavakpınar Mahallesi, Gülyalı Caddesi No: 9/B, Pendik / İstanbul, Türkiye, or from the email address you have previously notified to us and that is registered in our system, to kvkk@arya.codes. Your application will be concluded free of charge as soon as possible, and within thirty days at the latest, depending on its nature.
